In these terms and conditions, the following definitions apply:

• Agreement: an agreement in which the buyer purchases one or more products electronically via the seller’s website;
• Buyer: the natural person who does not act in the exercise of a profession or business, who purchases one or more products from the seller;

• Reflection period: the period within which the buyer can exercise their right of withdrawal;
• Right of withdrawal: the buyer’s option to cancel the purchase agreement within the reflection period;
• Day: calendar day.

The seller is: Flevodruk Ideeën B.V., operating under the name Uitgeverij Komma.

• These general terms and conditions apply to every offer from Uitgeverij Komma and to every agreement between Uitgeverij Komma and the buyer.

• When concluding the agreement, the text of these general terms and conditions is made available to the buyer electronically. The buyer can download the general terms and conditions from the website of Uitgeverij Komma for later reference.

• If an offer has a limited validity period or is made subject to conditions, this will be explicitly stated in the offer.

• The offer via the website of Uitgeverij Komma includes a description of the product offered. Images of products may differ slightly from the actual product. Dimensions, number of pages, and similar details of upcoming publications are indicative.
• Obvious mistakes or errors in the offer do not bind Uitgeverij Komma.

• The agreement is concluded by the buyer’s acceptance of the offer and compliance with the conditions attached to it.
• Uitgeverij Komma promptly confirms receipt of the buyer’s acceptance of the offer electronically.

• Uitgeverij Komma takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a safe web environment. Uitgeverij Komma also takes suitable security measures regarding electronic payments by the buyer.
• At the latest upon delivery of the product, Uitgeverij Komma will inform the buyer about the visiting address of the Uitgeverij Komma office where the buyer can submit complaints, as well as the conditions and manner in which the buyer can exercise the right of withdrawal.

The buyer can cancel an agreement within a reflection period of 14 days without giving any reasons. Uitgeverij Komma may ask the buyer for the reason(s) for the withdrawal but cannot oblige the buyer to provide them.

The reflection period starts on the day after the buyer has received the product. The right of withdrawal applies only to consumers.

During the reflection period, the buyer must handle the product and its packaging with care. He may only unpack, handle, and inspect the product as he would be allowed to do in a physical store.

The buyer is liable for any reduction in the value of the product resulting from handling the product in a way other than what is allowed.

• If the buyer exercises their right of withdrawal, they must notify Uitgeverij Komma of this within the reflection period in an unambiguous manner.
• As soon as possible, but no later than 14 days after the notification, the buyer must return the product or hand it over to Uitgeverij Komma. The buyer is deemed to have met the return deadline if the product is sent back before the reflection period expires.

• The buyer returns the product in full, if reasonably possible in its original condition and packaging.
• The risk and burden of proof for the correct and timely exercise of the right of withdrawal lie with the buyer.
• The buyer bears the costs of returning the product.

• Uitgeverij Komma confirms receipt of the buyer’s withdrawal notification electronically.
• Uitgeverij Komma refunds the buyer’s payments, except for any shipping costs charged by Uitgeverij Komma for the returned product, promptly but within 14 days following the day on which the product is received back.

• Uitgeverij Komma uses the same payment method for the refund that the buyer used, unless the buyer agrees to a different method. The refund is free of charge for the buyer.

• During the validity period stated in the offer, the prices of the offered products will not be increased, except for price changes resulting from changes in VAT rates.

• The prices mentioned in the offer include VAT.

• Uitgeverij Komma will exercise the greatest possible care when receiving and executing product orders.
• The place of delivery is the address provided by the buyer to Uitgeverij Komma.
• Uitgeverij Komma will execute accepted orders promptly but no later than 30 days, unless another delivery term has been agreed upon. If delivery is delayed or if an order cannot be fulfilled or can only be partially fulfilled, the buyer will be notified no later than 30 days after placing the order. In that case, the buyer has the right to cancel the agreement free of charge.

• After cancellation in accordance with the previous paragraph, Uitgeverij Komma will promptly refund the amount the buyer has paid in advance.
• The risk of damage and/or loss of products rests with Uitgeverij Komma until the moment of delivery to the buyer, unless explicitly agreed otherwise.

Unless otherwise specified in the offer from Uitgeverij Komma, the amounts owed by the buyer must be paid immediately upon the conclusion of the agreement.

• Complaints about the execution of the agreement must be submitted in writing to Uitgeverij Komma within 14 days after delivery of the product, or within 14 days after the buyer has discovered the defect, fully and clearly described.
• Complaints submitted to Uitgeverij Komma will be answered within 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Uitgeverij Komma will respond within the 14-day period with an acknowledgment of receipt and an indication of when the buyer can expect a substantive response.

• The buyer must give Uitgeverij Komma at least four weeks to resolve the complaint through mutual consultation. After this period, the dispute may be submitted to the subdistrict court.

Only Dutch law applies to agreements between Uitgeverij Komma and the buyer.
